Car Rental Terms and Conditions
These Terms and Conditions form an integral part of the Car Rental Agreement between the
Rental Company AddCar and the Renter. By signing the Rental Agreement, the Renter confirms
acceptance of these Terms and Conditions.

1. Driver Eligibility
- Minimum driver age is 21 years, unless otherwise stated in the rental agreement.
- Drivers must hold a valid driving licence for a minimum of one (1) year.
- An International Driving Permit may be required depending on the country of issue of the
driving licence.
- Only drivers authorised and listed on the rental agreement are permitted to drive the vehicle.

2. Vehicle Category & Replacement
- Vehicles are booked by category, not by specific make or model.
- The Company reserves the right to replace the reserved vehicle with a similar or higher
category vehicle at no additional cost if the booked vehicle is unavailable.
- No compensation or refund shall be due in the event of a vehicle replacement or upgrade.

3. Rental Period, Collection & Return
- The vehicle is rented for the period stated in the rental agreement.
- The vehicle must be returned on the agreed date, time, and location.
- Late returns may result in additional daily rental charges and administration fees.
- The vehicle must be returned in the same condition as collected, excluding fair wear and
tear.

4. Rental Charges & Payment
- Rental charges are calculated on a daily basis unless otherwise agreed.
- All prices are quoted in Euro (€) and include VAT unless stated otherwise.
- A valid credit card in the main driver’s name is required for security deposit.

5. Security Deposit
- A security deposit will be pre-authorised on the renter’s credit card at the start of the
rental.
- The deposit amount depends on the vehicle category and insurance selected.
- The deposit will be released within 20 to 30 working days after vehicle return, subject to
inspection, fines, or outstanding charges.

6. Insurance Coverage
- The rental includes Third Party Liability Insurance (TPL) as required by Maltese law.
- Collision Damage Waiver (CDW) and Theft Protection (TP) are included, subject to an
excess.
- Optional Super Collision Damage Waiver (SCDW) may be purchased to reduce the excess.
- The SCDW does not cover tyres, windscreen, roof, undercarriage, interior damage, lost
keys, misfuelling, or personal belongings.

7. Excess & Liability
- In the event of damage, theft, or loss, the renter is responsible up to the applicable
excess.
- The renter remains fully responsible for all damage caused by negligence, misuse, or
breach of these Terms and Conditions.
- Damage charges may include repair costs, loss of use, and administrative fees.

8. Fuel Policy & Misfuelling
- Vehicles are supplied with fuel as stated in the rental agreement and must be returned
with the same fuel level.
- Refuelling charges apply if the vehicle is returned with less fuel.
- The Renter must pay a refuelling service charge of 20 EUR plus missing fuel at
2 EUR per liter.

9. Use of the Vehicle
- The vehicle may only be driven within Malta and Gozo unless written authorisation is
provided.
- Cross-border travel outside Malta is strictly prohibited.
- The vehicle must not be used for illegal purposes, racing, towing, off-road driving, or
under the influence of alcohol or drugs.

10. Accidents, Damage & Breakdown
- Any accident, damage, or theft must be reported immediately or within 24 hours to the
Company.
- A police report is mandatory for accidents involving third parties or theft.
- Failure to report an incident may result in full liability and void insurance coverage.
- Roadside assistance is provided for mechanical failures not caused by negligence.

11. Insurance Void & Negligence
Insurance coverage becomes void if the vehicle is used:
- By an unauthorised driver
- Under the influence of alcohol or drugs
- Recklessly or negligently
- Off-road or outside permitted territory

12. Interior Damage, Smoking & Cleaning Fees
- Smoking inside the vehicle is strictly prohibited and subject to a cleaning penalty.
- The renter is responsible for excessive cleaning costs due to sand, spills, stains, pet
hair, or odours.
- The penalties for smoking inside the vehicles is €50.00.

13. Penalties
- The renter is responsible for all traffic fines, parking penalties, and violations incurred
during the rental period.
- The Renter will be charged the full amount of the penalty and an administration fee of
45 EUR for each.
- CVA Charges are to be paid by the hirer with an administration fee of 20 EUR for each.
- The Company reserves the right to charge the renter’s card after the rental period for
fines or penalties received later.

14. Additional Fee
- Airport Location fee of 25 EUR, including tax, is not included in the rental amount.
- Out of Hour Fee (OOH) of 25 EUR, including tax, for pick up and drop-off.
- Additional fees may apply.

15. Cancellation & Early Termination
- Cancellations are subject to the Company’s cancellation policy.
- No refunds are given for early returns unless otherwise agreed.

16. Pet Policy
- If you wish to put an animal in the car, you must take all necessary precautions to keep
the car clean. If not, the cleaning fee will apply.

17. Data Protection (GDPR)
- Personal data is processed in accordance with GDPR and Maltese data protection laws.
- Data is used solely for rental, insurance, legal, and administrative purposes.

18. Governing Law
- This agreement is governed by the laws of Malta.
- Any disputes shall be subject to the jurisdiction of the Maltese courts.

19. Technical Fault
In case a car suffers from a technical fault or damage, which is due to misuse, negligence, or
other causes by the car renter/renters, the car renter/renters are liable for the direct and
potential indirect repairs costs in full. If the car is under warranty, the car renter/renter is only
liable for the related costs which are not covered and compensated to the car rental by
warranty.
